The present Original Application has been filed by the applicant seeking therein the following reliefs:

“8.1  That by a suitable writ/order or the directions the respondents be directed to consider the representation of the applicant submitted on 18/2/2019 and looking to the facts of the case as till the date total 17 posts of unreserved category are still lying vacant, therefore, appointment be allowed to the applicant against the unreserved category as the applicant has secured 67.91% marks and has secured a good position in the merit list.

8.2  That by a suitable writ/order or the directions the condition as has been stipulated vide Annexure A/2 be quashed and set aside being arbitrary, unjustified and contradictory to the rules over the subject.

8.3  Any other relief which the Honourable bench deems fit.”

At the very outset, learned counsel for the applicant states that before filing the present Original Application, the applicant moved a representation before the respondents on 18.02.2019, which has not been decided as yet.  He further states that the applicant would be satisfied if a time bound direction is given to respondents to take a decision over his said representation.

Keeping in view the aforesaid limited prayer of learned counsel for the applicant, we deem it appropriate to dispose of the present Original Application at the admission stage without entering into the merits of the case.  

Accordingly, the present Original Application is disposed of with a direction to respondents to take a decision over the applicant's representation and pass a reasoned and speaking order in accordance with law within a period of two moths from the date of receipt of a certified copy of this order. A further direction is issued that before taking any decision over the applicant's representation, he shall also be afforded an opportunity of hearing. 

Ordered accordingly.  No order as to costs.
